I have a contract problem question which i really need help with?
Andrew was collecting tokens from a daily newspaper. When he Had collected all ten available over a fortnight he could send away for a collectors royal wedding pack, which included a special £2 coin, a mug, tea towel, book and DVD about the royal couple.
On the last Friday of the promotion, Jack is late going to the shops and finds all copies of the newspaper are sold out. He is extremely disappointed. He mentions this to his friend Tom in the pub that night. Tom said he bought the newspaper that morning. Andrew offers Tom his £50 watch in exchange for the token in the newspaper. Tom readily agrees.
When Andrew sends away for the royal pack, the paper only sends him the coin and the mug. When he queries this, the newspaper say the tokens are of no value and so they are under no legal obligation to provide anything to him. Andrew also regrets giving his watch away.
Advise Andrew in relation to the newspaper, and also whether the agreement with Tom is legally binding.
In terms of the problem with Tom, he can’t really go back on it as Andrew did make a deal.
In terms of the newspaper, if it stated very clearly on the paper/promotion that the promotion was over, then you cannot challenge them. If they didn’t, then you may be able to go to the Small Case Courts with it.
Either way, it was a VERY STUPID MISTAKE to give away your watch for a royal wedding package, woth about £10 and you should have read the details of the promotion very clearly if you were going to give away ur £50 watch for it!!!
