My coffee carafe exploded with my hand inside requiring 6 stitches and 2-3 days off work. Do I need a lawyer?
I had just filled the carafe with Warm Water and emptied it as I have many times before; I put my hand in with a paper towel to wipe the bottom. As soon as my hand was inside the glass inner part exploded causing a laceration on my wrist which has me down a coffee maker, off work several days and possibly with hospital bills (I received 6 stitches, any deeper and we are talking arterial bleeding). Should I speak with a lawyer then contact the company or vice versa. I’m not looking to get rich I just don’t want stuck with the costs for what appears to be a product fault.
Thanks for any help.
Thanks for the advice.
I’ll prolly just write the manufacturer, and see what they say.
You should contact a lawyer – most will do a consultation for free, and work with you on the fee, especially if you have a case. If you contact the company first they may pressure you to settle and you’ll lose out on your rights to sue. You were injured and you deserve compensation.
Your injury reminds me of one of the classic cases in product liability where a woman was injured by an exploding coke bottle. The glass bottle exploded in her hand in the store while she was removing it from the shelf. (Escola v Coca Cola Bottling Company of Fresno, 150 P.2d 436 (Cal. 1944)) I couldn’t say for sure if you have a case, but it seems like you may. The one hitch would be if there was a warning enclosed with the carafe when you bought it. A lawyer would be able to evaluate and tell you for sure.
